ORDINANCE NO. 02012 -010 <br />AN ORDINANCE of the City Council of the City of Tumwater, <br />Washington, related to fireworks and amending Chapter 8.30 of the <br />Tumwater Municipal Code, as more particularly set forth set forth <br />herein. <br />WHEREAS, the unlawful discharge of consumer fireworks has become an <br />increasing problem for cities; and <br />WHEREAS, the Tumwater City Council finds that it is necessary for the <br />public health, safety and welfare to regulate, prevent and prohibit conditions <br />which may increase fire hazards and other safety and health hazards, and <br />generally create a menace to the health, safety and welfare of the public; and <br />WHEREAS, the sale and discharge of consumer fireworks is governed by <br />state law, as contained in Chapter 70.77 RCW, and its implementing regulations, <br />as contained in Chapter 212 -17 WAC; and <br />WHEREAS, pursuant to RCW 70.77.250(4), cities may enact ordinances <br />that are more restrictive than state law provided an effective date is no sooner <br />than one year from the date of adoption; and <br />WHEREAS, the Tumwater City Council held a public hearing on April 17, <br />2012 to allow the public to express their concerns about the sale and discharge of <br />consumer fireworks; and <br />WHEREAS, following testimony from a number of citizens, as well as <br />operators of charitable fireworks stands, and based on the staff report and all <br />evidence presented, the City Council finds that it is in the best interest of the <br />citizens of the City to further limit both the discharge of consumer fireworks and <br />the number of fireworks stands permitted; and <br />WHEREAS, the City Council wishes to delegate to the fire chief or <br />designee the authority to investigate applicants for fireworks stand permits, and <br />to issue, deny or revoke such permits under RCW 70.77.260 and RCW 70.77.270; <br />and <br />WHEREAS, the City Council finds the proposed amendments support the <br />health, safety and welfare of the residents of the city of Tumwater. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF <br />TUMWATER, STATE OF WASHINGTON, DOES ORDAIN AS FOLLOWS: <br />Ordinance No. 02012 -010 —Page 1 of 6 <br />
